TRIP CONTRACT

Please read the following contract terms and conditions carefully. THIS BOOKING FORM IS THE CONTRACT BETWEEN YOUR PARTY AND ADVENTURES WITHOUT BORDERS ("Company" or "AWB"). This Contract is legally binding when (1) you make a booking, and (2) the Company accepts it by signing and returning the Contract to you by mail, fax or email, and (3) the Company has received your NON REFUNDABLE deposit of Two Hundred U.S. Dollars ($200 U.S.). You may pay your deposit and final payment via wire transfer or bank draft, the details of which will be forwarded to you when your booking has been accepted. All funds are in U.S. currency.

  1. How To Book
    Carefully read the following Contract Terms and Conditions. Complete and sign this Contract, the Fitness/Adventure Experience Questionnaire and the Medical Form (collectively, the "Required Forms"). Only one Contract (signed by each member of your party) is required. However, each member of your party must complete the Fitness/Adventure Experience Questionnaire and Medical Form. The signed Trip Description Confirmation (See Paragraph 12 below) and full payment of the balance of your Contract Amount are due 60 days prior to your departure date. If the booking is made 60 days or less prior to the departure date, your full payment of the Contract Amount must accompany the Required Forms. If full payment is not made on time, AWB reserves the right to cancel your booking and apply cancellation charges as outlined below.
  2. Cancellation Policies
    Cancelations must be made in writing by the person designated below as the party representative ("Party Representative"). A liquidated damages/cancelation fee will apply as follows to any trip that is canceled: (a) 60 days or more prior to your departure date, your deposit; (b) 30 to 59 days prior to your departure date, fifty percent (50%) of the Contract Amount; and (c) less than 30 days prior to your departure date, one hundred percent (100%) of the Contract Amount.
  3. Requests to Change your Booking
    The Company will use reasonable commercial efforts to accommodate changes to your booking so long as the Company receives a written request from the Party Representative (z) no less than 60 days prior to your departure date and (y) a processing fee of Fifty U.S. Dollars ($50). The Company cannot guarantee that it will be able to accommodate any request for a change. The processing fee will apply whether or not any change is made.
  4. Trip Cancelation by the Company
    The Company reserves the right to cancel your trip for any reason, in the sole discretion of the Company. If the Company cancels your trip, with the exception of $50.00US to cover administrative costs, the Company will refund the remainder of the amount paid by you prior to cancellation. If the Company cancels, it will use reasonable commercial efforts to provide the Party Representative with notice of cancelation not less than 30 days prior to the departure date of your trip and, if you so desire, to reschedule your trip to another date mutually agreed between the Party Representative and the Company.
  5. No Refund on Unused Services
    The Company will not provide a refund or credit for any unused services or for early termination of the trip for any reason that is beyond the control of the Company, including, without limitation, inadequate physical conditioning of any member of your party or disease, death or injury suffered by any member of your party. In addition, if the Company determines that any member of your party is compromising the safety, security or success of the trip, the Company reserves the right to terminate the trip without refund or credit to the responsible person or persons or your entire party if the Company determines that course of action to be prudent and advisable.
  6. Health
    Each individual joining the trip is solely responsible for his or her physical and medical condition and hereby expressly releases and discharges the Company for any liability of any kind whatsoever arising out of his or her physical or medical condition. Any individual with a medical condition that is material in connection with the trip shall disclose that condition to the Company and provide the Company with a written medical clearance from his or her physician prior to the departure date of the trip. The Company reserves the right to exclude from the trip any individual the Company determines to be a physical or medical risk.
  7. Insurance
    Each member of your party must provide the Company with written proof of insurance no later than 60 days prior to the departure date of the trip. Coverage shall include travel, personal injury, medical expenses, repatriation expenses and evacuation expenses. Each member of your party hereby releases and discharges the Company and its representatives, directors, employees, contractors and agents (collectively, "Company Representatives") from any and all known and unknown claims, demands, damages, liabilities, costs and expenses (collectively, "Claims") that are covered by or should be covered by any such required insurance policy.
  8. Travel Documents
    Each member of your party shall provide the Company with a copy of his or her passport and visa, if applicable, no later than 60 days prior to the departure date of the trip. Each such passport shall be valid for not less than seven (7) months from the departure date of the trip and each such visa shall be valid for not less than thirty (30) days after the scheduled completion date of the trip. Each member of your party hereby assumes all risks associated with the validity and acceptance of his or her passport and visa in connection with this Contract.
  9. Trip Safety
    Each member of your party hereby agrees to fully comply with all instructions issued by the Company through Company Representatives with respect to the operation and safety of the trip and agrees to fully comply with all applicable, laws, customs and regulations, including, without limitation, criminal laws, drug laws and civil laws.
  10. Adventure Travel Risks
    Each member of your party hereby represents and warrants to the Company that he or she is fully and completely aware of all of the actual and potential risks associated with adventure travel, in general, and this trip, in particular and assumes all risks associated with the trip. Each member of your party acknowledges and agrees that the Company shall have no liability with respect to the actual or potential risks and dangers associated with the trip – each such member of your party having obtained such insurance as he or she deems to be reasonable and appropriate with respect to the trip. Each member of your party hereby assumes full responsibility for any illness, accident, injury, death, delay, loss or damage which may occur in any manner on or in connection with the trip and acknowledges and agrees that the Company cannot anticipate and is not responsible for the conditions of the routes being used on the trip, weather conditions, political conditions or the skill or judgment of any of the participants in the trip.
  11. Baggage and Personal Belongings
    Each member of your party hereby assumes all risks of every kind and nature associated with his or her funds, baggage and personal belongings and acknowledges and agrees that neither the Company nor any of the Company's representatives shall have any liability of any kind whatsoever for any loss or damage with respect to the funds, baggage or personal belongings of any member of your party.
  12. What is included in your trip
    When the Company has accepted your Contract, it will issue you a confirmation which describes your trip in more detail ("Trip Description Confirmation") and an invoice for the Contract Amount less the deposit ("Trip Invoice"). Please sign and return the Trip Invoice to the Company by fax or email and pay the Trip Invoice no later than 60 days prior to the departure date of your trip.
  13. The Terms of this Agreement
    Each of the undersigned members of your party hereby agrees as follows:
    • He or she is medically, physically and in all other respects, fit and fully able to participate in this adventure travel trip and has no special medical requirements or conditions except as otherwise disclosed in writing in the Medical Form.
    • He or she knowingly and voluntarily assumes all known and unknown risks associated with the trip and has elected to take the trip based upon his or her own knowledge, beliefs and evaluations and has not relied upon any representations of any kind from the Company with respect to the risks associated with the trip.
